“Collaborative law process” means the process in which the parties and any professionals engaged by the parties to assist them agree in writing to use their best efforts and to make a good faith attempt to resolve disputes related to the family law matters as referenced in subdivision (a) on an agreed basis without resorting to adversary judicial intervention. Collaborative law is a relatively new and modern approach to the divorce process. At Ginzburg & Bronshteyn, APC, we are trained in the Collaborative Law process to assist divorcing couples with a non-litigious divorce. The Collaborative Law process is based on mutual respect and agreement. Each party agrees to work together, outside of court, utilizing their own Collaborative Law attorney, to come to a mutually agreeable divorce settlement. This process is not for every divorcing couple, as it requires communication, full disclosure and a willingness to compromise. Focusing on problem solving rather than blame and accusations, the Collaborative Law process can be a positive end to a bitter situation.
