Community Property

California is a community property state, meaning that all property, assets and debts of the two spouses accumulated during marriage are usually split evenly in a divorce or separation. This often gets complicated, especially in high net worth situations, or in cases involving business interests, investments and complex or numerous types of assets and debts. Significant work goes into determining which spouse walks away with which assets and which debts. Through forensic accounting, we may be able to find any hidden or otherwise protected assets that your spouse may be trying to withhold from divorce proceedings or divisions.

We are also prepared to handle complex division of business interests. Experts can evaluate the holding in question, and we will be able to guide you through the process of valuing, separating the contributions and holdings until all assets and property are fairly divided.

We are ready and prepared to represent the interests of individuals facing reimbursement matters. In instances where one spouse had contributed separate property to a community residence or business, we can help recover funds.

There may be other reimbursement issues which result on post-separation expenses that are paid on behalf of the other spouse or the community. Our lawyers are also prepared to represent the interests of a spouse who has paid child support, spousal support or other financial responsibilities before an agreement was reached. We help to ensure that he or she receives credit for the funds paid, particularly if he or she was paying direct debt or expenses of the other spouse.
